This Privacy Policy applies to all AxEnd products, services, and related applications.

This is the privacy policy (“Privacy Policy”) that governs how we, AxEnd, Inc. (“AxEnd”, “we”, “our”, or “us”), use Personal Information (as defined below) that we collect, receive, and store about individuals in connection with the use of the Device (any AxEnd products including AeroSense branded products), the use of any related Applications, and the use of the website www.ax-end.com (together with Its sub-domains, content and services). We may choose to engage a third-party provider to provide cloud services, hosting, support, or other services. This means that the data you provide to us, or that we collect from you (including any personal information) – as described below – may be hosted with such third-party service providers on servers that they own or control. Regardless of where such third-party service providers are located. Your data may even be replicated across multiple servers located in multiple countries.

At AxEnd, we believe in our user’s privacy. This means that we strive to collect only the personal data that we need. The personal data AxEnd collects depends on how you interact with AxEnd devices. In order to provide users with a more accurate and personalized service, we may collect, store and use the following data regarding the device, application, and website users: name, age, height, etc. Because of the difference in the models of devices and the versions of applications the data we collect may vary. Some of our products and services may have their own specific feature, we will always notify you regarding the collection, use, and sharing of this data through policy updates (which may be in the form of licensing agreements, usage information, etc.) if you do not provide the necessary data, you may not achieve the best results of our services. we respect and will protect the privacy of all of our users. Unless otherwise provided in this policy, the application will not disclose any data to the public.

This privacy policy does not apply to products and services provided to you by third parties. The products and services provided to you by third parties are subject to the third party's privacy policy. For example, when a healthcare provider provides services to you, the personal information you provide to the healthcare provider applies to the healthcare provider's privacy policy.

You undertake and warrant that your family members and other users are aware of and agree to this policy when using AxEnd Products.

We have implemented this Privacy Policy because your privacy, and the privacy of other users, is important to us. This Privacy Policy explains our online information practices and the choices you can make about the way your Personal Information is collected and used in connection with the use of the Product and the Applications.

This Privacy Policy forms part of our User Agreement, which can be viewed from within the App or on www.ax-end.com. Any capitalized but undefined term in this Privacy Policy shall have the meaning given to it in the Terms.

1.Consent and Modification.

You are not legally obligated to provide us Personal Information, and you hereby confirm that providing us Personal Information is at your own free will. By using the App and/or the Product, you consent to the terms of this Privacy Policy and to our collection, processing and sharing of Personal Information for the purposes set forth herein. If you do not agree to this Privacy Policy, please do not access, or otherwise use the Application and/or Device. We reserve the right, at our discretion, to change this Privacy Policy at any time. Such change will be effective following posting of the revised Privacy Policy on the Site, and your continued use of the Application and/or Device thereafter means that you accept those changes.

2.HOW WE COLLECT YOUR INFORMATION

We receive and/or collect Personal Information from you in the following ways:

1.Creating an Account. In order to use the App and the services provided in connection therewith, you may be required to create an account (“Account”). We may offer different options to create an Account. If you create an Account you will be required to provide us with certain information, such as your name and email address, as well as a password that you will use for your Account (“Account Information”), and any subsequent information that may be required to provide you with the full services the AxEnd’s products can provide. You may also choose to provide additional Personal Information as part of the Account registration process and in connection with your ongoing use of your Account. We may send you an e-mail to the e-mail address you submit to confirm your registration. If you choose not to create an Account, you will not be able to access or use the application.

2.‘Contact Us’ Information. If you send us a “Contact Us” request by submitting an online form that we make available, you may be required to provide us with certain information such as your name and email address.

3.Location Data. We may obtain certain data based on the Wi-Fi connection received by the Products.

4.Data collect when using the products or applications. AxEnd’s products collect user data to help determine potential health factors that may deviate from the norm. This data is collected on a daily basis based on the movements and habits of the Users.

3.HOW WE USE YOUR INFORMATION

When you use our products and/or services, we need/may need to collect, and use personal information. In order to provide you with the basic functions of our products/services, and by agreeing to this document you hereby authorize us to collect and use the necessary information. If you refuse to provide the information, you will not be able to use our products/services properly. In order to provide you with additional features of our products and/or services, you may choose to authorize us to collect and use the information. If you refuse to provide it, you will not be able to use the additional features properly and you will not be able to achieve the full functional effects but will not affect your normal use of the basic functionality of our products and/or services.

1.If you are a Product user, we will collect detected motion data collected by the sensor contained within the Product (“Motion Data”). We will use such Motion Data to: (i) operate, maintain, and support the App and Software and provide you with the services related thereto; and (ii) transfer your Motion Data to the App user designated by you (“Designated App User”) and provide such Designated App User with information and notifications regarding your Motion Data. This Motion Data will also be used in determining disease risk factors.

2.We will use any personal information that we collect or obtain in connection with the Application, such as your name, email, and phone number, in order to provide you with information and notification regarding Motion Data of a specific Device user that selected you as an Emergency Contact.

3.We will use your Personal Information to: (i) maintain and improve our App and Product and to provide the related services; (ii) contact you in connection with the App and/or Product and certain programs or offerings that you may have registered for; and (iv) identify and authenticate your access to the App and/or Software.

4.We may use your designated email address to: (i) send you updates or news regarding the App and/or Product and our products: and/or (ii) respond to a “Contact Us” or administrative request (for example, to change your password).

5.We may transfer your Personal Information to our local or foreign subsidiaries or affiliated companies for the purpose of storing or processing such information on our behalf. Such information may be transferred to other countries. We require that these parties agree to process such information in compliance with our Privacy Policy.

6.We may share your Personal Information with our third party service providers and partners, but only to assist us with our business operations and to provide our products and services to users. Such information may be transferred to other countries. We use commercially reasonable efforts to only engage or interact with third party service providers and partners that post a privacy policy governing their processing of Personal Information.

7.We may disclose your Personal Information or any information you submitted via the App and/or Product if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our EULA, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of AxEnd, our users, yourself or the public.

4.Use of Anonymous Information. We may use Anonymous Information (as defined below) or disclose it to third party service providers in order to improve our App and Product and enhance your experience with the App and Product. We may also disclose Anonymous Information (with or without compensation) to third parties, including partners. “Anonymous Information” means information which does not enable identification of an individual user, such as aggregated information about the use of our Application and/or Devices.

5.Opting Out.

You may choose not to receive future promotional, or other App and/or Product-related emails from us by selecting an unsubscribe link at the bottom of each email that we send. Please note that even if you opt out of receiving the foregoing emails, we may still send you a response to any “Contact Us” request as well as administrative emails (for example, in connection with a password reset request) that are necessary to facilitate your use of the App and/or Product.

6.Choice.

At all times, you may choose whether or not to provide or disclose Personal Information. If you choose not to provide mandatory Personal Information, you may be unable to access certain options, programs, offers, and services included in the Application and Device.

7.Access/Accuracy.

To the extent that you do provide us with Personal Information, we wish to maintain accurate Personal Information. If you would like to delete or correct any of your other Personal Information that we may be storing, you may submit an access request by contacting through the App. Your email should include adequate details of your request.

8.Links to and Interaction with Third Party Products. The App and Product may enable you to interact with or contain links to your Third-Party Account and other third-party websites, mobile software applications and services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third-Party Services. Please be aware that the Third-Party Services may collect Personal Information from you. Accordingly, we encourage you to read the terms and conditions and privacy policy of each Third-Party Service that you choose to use or interact with.

9.Security. The security of Personal Information is important to us. We follow generally accepted industry standards, including the use of appropriate administrative, physical and technical safeguards, to protect the Personal Information submitted to us. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use reasonable acceptable means to protect your Personal Information, we cannot guarantee its absolute security or confidentiality. If you have any questions about security on the Application and/or Device, you can contact us through the Application.

10.Merger, Sale or Bankruptcy. In the event that we are acquired by or merged with a third-party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer or assign Personal Information in connection with the foregoing events.

11.California Privacy Rights. California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please contact us through the App. Please note that we are only required to respond to one request per customer each year.

HOW WE USE SDK TECHNOLOGY

To ensure the stable operation and functionality of our Devices, enabling the use of our services and features, our applications will be embedded with an SDK created by an authorized partner. We conduct rigorous security testing of authorized partner’s application interfaces (APIs), software tool development kits (SDKs), strict data protection measures are used to process personal information in accordance with this policy and any other relevant confidentiality and security measures.

SHARING OF PERSONAL DATA

AxEnd may share personal data with service providers who act on our behalf, our partners, or others at your direction. Further, AxEnd will not share personal data with third parties for our own marketing purposes.

1.Service Providers. AxEnd may engage third parties to act as our service providers and perform certain tasks on our behalf, such as hosting of servers. AxEnd service providers are obligated to handle personal data consistent with this Privacy Policy and according to our instructions. They cannot use the personal data we share for their own purposes and must delete or return the personal data once they have fulfilled their services.

2.Others. AxEnd may share personal data with others at your direction or with your consent, such as when we share information with your carrier to create your account. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or to protect our operations or users, or in the event of a reorganization, merger, or sale.

HOW WE PROTECT YOUR INFORMATION

(1)In order to protect your information, we have taken reasonable and feasible security measures to protect the personal information you provide from unauthorized access, public disclosure, use, modification, damage, or loss. For example, when exchanging data between your browser and server we, are protected by SSL protocol encryption, use encryption to improve the security of Personal Information, use trusted protection measures to protect personal information from malicious attacks, deploy access control mechanisms to ensure that personal information is accessible only to authorized persons, and organize security and privacy training courses to raise employee awareness of the importance of protecting personal information.

(2)We will take reasonable and feasible measures to avoid collecting unrelated personal information. We will only retain your personal information for as long as necessary to achieve the purposes set out in this policy, unless there are mandatory retention requirements under the law, such as the E-Commerce Laws of the United States of America. Our criteria for determining the aforementioned period include:

a.Completing services, transaction purposes, maintain the corresponding transaction and service records, respond to your relevant inquiries or complaints.

b.To ensure that we provide you with products and services of safety and quality.

When your personal information exceeds the retention period, we will delete or anonymize your personal information as required by applicable law.

(3) The Internet is not 100% secure, and although we have these security measures, please understand that there are no "perfect security measures".

(4) In the event of an unfortunate personal information security incident, we will inform you in accordance with the requirements of laws and regulations: the basic circumstances and possible impact of the security incident, the measures we have taken or will take to deal with the situation, your own prevention and reduction of risk recommendations, remedial measures against you, etc. Event-related circumstances we will inform you by mail, letter, telephone, push notification and so on, it is difficult to inform the subject of personal information one by one, we will take a reasonable and effective way to issue an announcement.
